Miner Ship Owner Mehmet Madenci reacted strongly to the evacuation and transfer of his shipyards by Milli Emlak. The miner said, “The shipyard area has been seized and it has been decided to transfer it to a tender. Our allocated land, which we have built with our own capital after losing our right, is being donated to others by way of tender.”
In the statement made by Mehmet Madenci, Chairman of the Board of Directors of Madenci Gemi Sanayii Limited Şirketi, “As of today, the General Directorate of National Real Estate of our state decided that our shipyard has not fulfilled its allocation commitments and decided to evacuate, and the shipyard area was seized and it was decided to be transferred to a tender. Unfortunately, our right here has been overturned and our allocated land, which we built with our own capital, is being donated to others by way of tender,” it said.
37 SHIPS BUILT
In the statement made by Mehmet Madenci, the following statements were given:
“Mining Ship Industry was established on April 1, 1980 in Zonguldak Province, Kdz. It was established in Eregli district. Mining Ship Industry has always been the first to build different kinds of ships in the shipbuilding industry and has always succeeded in breaking new ground. It has built 37 ships so far and exported all of them to all over Europe on turnkey basis. Madenci Gemi Sanayii is proud of being the first shipyard to be awarded the export award by the government of the Republic of Turkey. Our shipyard since 1983, when we started manufacturing and exporting ships; From the ships we exported, we earned 500 million USD in foreign currency, paid 100 million USD in taxes, paid 125 million USD in SSI, and most importantly, created direct employment at the level of 10 million people/day.
EMPLOYMENT TO 1180 PEOPLE
Our shipyard allocation area is 220.000 m2 and it has been allocated from our state free of charge and indefinitely in return for our investment commitments in accordance with the abolished article 5 of the Law No. 5084. In 2007, our shipyard employed 1180 people, and by 2013 it had filled the ship orders. For this reason, it is foreseen to switch from 4 sledges to 7 sleds with the new investments, and it has committed to provide 25 million TL investment and 2000 people employment as an investment commitment. Unfortunately, the outbreak of the world economic crisis in 2008 put many sectors in a bad situation in the world, but the biggest damage was experienced in shipbuilding and management. Due to force majeure reasons that are beyond our control, our company has suffered a high degree of damage from this economic crisis. For this reason, two of our ships were left on the slipway and sea filling and investments (the front of the ships would be blocked and closed workshops would be built where the slipways were) could not be completed according to the investment project. In 2019, our state bank Eximbank made it possible to continue the investment with the execution of the sale of the ships, but this time the investment period has expired.
IT HAS BEEN DECIDED TO TURN THE AREA BY SEALING
As of today, the General Directorate of National Real Estate of our state decided that our shipyard has not fulfilled its allocation commitments and decided to evacuate, and the shipyard area was seized and it was decided to be transferred to a tender. Unfortunately, our right here is defeated and our allocated land, which we built with our own capital, is given to others by way of tender. The data that led us to this thought are as follows:
1- Making it reasonable with the allocation of 5084 and the temporary article 14 of the law no 4076. Our shipyard area has been filled with 160,000 m2 and includes its own private port. While the said area was the sea before, it was acquired by filling it completely with our own capital and we have revived a new shipyard area for our country. For the current state of our shipyard, Kdz. Ereğli 1st Civil Court of First Instance was requested to determine the investment amount and the court determined the amount as 38,581,056 TL. The investment we have committed is over 25 million. The General Directorate of National Real Estate, on the other hand, stated that the investment amount was 8,260,599 TL and requested his release. How this figure was reached is not specified. It has been verbally said that it was calculated according to 2007, that the investment amount was much higher at that time, with invoices and documents.
2- Employment was a commitment. According to the temporary 14th article of the Law No. 4076, which came into force later, the number of employments was reduced by half and each person was revised for one month. The number committed by our company has also been revised as 1000 people / each person for one month. Unfortunately, our state does not include subcontracted workers in this number of employment. It is clear that without our shipyard, there would be no subcontractor personnel employed. In addition, the belief that this system would be more beneficial to the country’s economy was taken into account in order to create new taxpayers and to increase the number of specialist employment. This employment is always the responsibility of our company as a top employer and has been accepted as our company’s personnel in different ministries of our state and in our legal system. Namely, in case of problems such as work accident or getting a salary, the responsibility first falls on the Mining Ship Industry, which is the place of work. If these personnel are not counted as employment, how are the ships we exported built? In the agreement with Milli Emlak, it is not stated that we cannot use subcontracted personnel or that they will not be counted as employment. The number of employment and workplace can be easily seen from the SSK payrolls.
3- Paragraph 14 c) of the temporary article of the law no 4076 and the current market value of the land with an investment of 8.260.599 TL and a land of 187.331.296 TL. That is to say, our General Directorate of National Real Estate has made an application that if the investor, who is the c) of the 14th article of the law no 4076, fulfills 35% of the amount committed by the investor, the allocation can be obtained by paying the land price, but the above-mentioned 8.260,599 TL investment they made. It states that we cannot benefit because it is 33.4. It was also stated that the land value was 187.331,296 TL. Although it is determined that you have invested 1.6% more, which is meant to be told to us here, it has been reported that I have to pay 187.million TL fair value for the land. It is our investments that create the market value of this 187 million TL land, and we are asked to pay for the value we bring to our country. In addition, how can he make an investment of 8,260,599 TL and create a current value of 187.331,296 TL in return. Is it possible? It is not possible. The document contradicts itself in every aspect and only intimidates us. Even if you catch 35%, you will pay 187 million, trying to say don’t bother. It is intimidation and intimidation. In addition, it is reported in the National Real Estate reports that our investment commitment has been completed by 60% in terms of investment amount. They are looking for such a way out to refute their own reports by declaring that they have come to 33.4% by deducting them from the investment amount since my machinery equipment was purchased before and it is old. He made these reports himself, that is, his own reports that he submitted to the court to which he was a party.
4- Allocation according to the law no 4706 (the right of use for 49 years and the allocation with the rent share from the turnover) While the Yalova shipyards, which were allocated after us, and the Tuzla shipyards, which were renewed again, benefited from the law no 4706, we stayed at 5084. This is unfair, there is no equality. In addition, while the land was allocated to them, we revived the land ourselves. While they were given the rights to transfer, sell, buy and rent partners, these rights were deprived of us. The worst part is that our shipyard land, which will be confiscated from us, has been put out to tender in accordance with the law no. 4706. If we had been given this opportunity, we could have sold or bought a partner and healed the wounds of the 2008 crisis. We could close our tax and insurance debts to our state, (this amount is close to the tender price), and we could pay the severance pay of our 500-600 employees who have the right. For 12 years, we have tried to keep our company afloat in order to pay the dues of our employees and to pay our debts to our state. In return, our 40-year-old company is on its way to becoming history, without any payment being received and naturally the debt is settled.
5- The market value of the land is 187.331,296 TL for us, but the current market price in the tender is 35,865,875 TL.
PESKEŞ CLAIMS ARE TRUE
While the current market value of the land was reported to our company as 187.331,296 TL, it was put out to tender as if it was smuggling goods from the fire while the legal process was continuing. In the tender, the current market value of the land was presented as 35,865,875 TL. Here, it is revealed again that our right has been defeated and it is a sign that our 40-year history has been given to third parties.
OUR SHIPYARD IS USED, THE WORKER’S ALTERI IS IGNORE
All of these are indications of our rightness in our position and our loss of our family’s wealth, the sweat of our employees and the compensation they did not receive, the usurpation of our place which was a shipyard when it was the sea, which we created out of nothing. It is the disregard of the efforts of my father, Mehmet Arif Madenci, who worked day and night for these rights and died because he could not bear his weight. This confusion is reinforced by the petitions filed by companies that applied for the transfer of the allocation while the allocation investment period was still behind the decisions that do not comply with the law and business ethics. According to the statements made by politicians and bureaucrats, it plays an important role in accelerating it. Namely, a commission was established for the shipyards and it was said that support would be given to our subject, and it was announced on the television in the middle of the city center that these places would be given to new investors two weeks later. With this political power, the General Directorate of National Real Estate did not count our investment and employment unfairly and closed us with 187 million. While the court process was continuing, the General Directorate of Shipyards opened the way for the transfer of the Miner Ship Industry to 3rd parties by placing a tender for 35 million for the urgent transfer. This tender, which was made before the legal dimension was concluded, causes irreversible damages to our company. Our righteousness has been strengthened by the documents we have, and we have full faith that it will be confirmed by our supreme justice. Our request from you is to support our family, our company, and most importantly, our employees, who represent our country in the world, who have made profits for our country and our state for years, who stand by the people of Ereğli without expecting anything in return, and most importantly, that you do not leave us alone. We declare that our company will continue its struggle for more than 10 years without compromising its determination, and we present it to the public with respect.”
